The 400 Bad Request: Understanding Direct Fee Payment for Title II Claimant Representation

The Social Security Administration (SSA) has implemented a Proactive Disclosure policy, which allows attorneys and non-attorneys eligible for direct fee payment to represent clients with disabilities under Title II. This policy aims to provide more flexible and cost-effective representation options for these individuals.

What is Direct Fee Payment?

Direct fee payment refers to the provision of legal representation by attorneys or non-attorneys without a fee being charged to the client. Under this arrangement, the representative provides services at their own expense and is reimbursed for expenses related to their work.

The Benefits of Direct Fee Payment

One of the primary benefits of direct fee payment is cost savings for clients. By avoiding fees charged by attorneys or other third parties, clients can allocate more resources towards medical treatment and other necessary expenses.

Another advantage of direct fee payment is flexibility. Clients may work with multiple representatives without incurring additional fees, as the services are provided directly by the SSA's Office of Disability Adjudication and Claims Processing (ODACPP).

The Requirements for Direct Fee Payment

To be eligible for direct fee payment, attorneys and non-attorneys must meet certain requirements. These include:

The Proactive Disclosure Policy

The SSA has issued a Proactive Disclosure policy to inform attorneys and non-attorneys about the potential for direct fee payment. This policy outlines guidelines for representing clients with disabilities under Title II, including requirements for certification, registration, and reporting expenses.

The Proactive Disclosure policy emphasizes the importance of transparency, honesty, and professionalism in representing clients under this arrangement. It also encourages attorneys and non-attorneys to seek guidance from the SSA's ODACPP before engaging in direct fee payment representation.

Conclusion

In conclusion, direct fee payment for Title II claimant representation by attorneys and non-attorneys eligible under the SSA's Proactive Disclosure policy offers numerous benefits. By providing cost savings, flexibility, and increased access to medical treatment, this arrangement can be a valuable resource for individuals with disabilities.
